These Provider Terms govern participation as a Provider on Black Landcestry. By creating a Provider profile, listing services, accepting bookings, communicating with Users, uploading documents, receiving payouts, or otherwise using Provider features, you agree to these Provider Terms, the Terms and Conditions, the Privacy Policy, and all policies presented through the Platform.
01 Independent Provider Status
Providers are independent businesses, professionals, or individuals. Providers are not employees, agents, partners, joint venturers, representatives, or franchisees of the Platform. Providers control their own Services, subject to Platform rules and applicable law.
02 Provider Categories
Provider categories may include advocates, attorneys, researchers, writers, media professionals, content creators, paralegals, legal researchers, and other justice-related service providers. Category labels are for Platform organization and do not constitute verification, licensure confirmation, certification, endorsement, or approval.
03 Credential Accuracy and No Platform Verification
Providers are solely responsible for ensuring that all profile information, credentials, biographies, service descriptions, rates, documents, and representations are accurate, current, lawful, and not misleading. The Platform does not independently verify credentials, licensure, qualifications, background, insurance, professional standing, or experience.
Providers may not claim or imply that the Platform has verified, certified, approved, vetted, screened, recommended, or endorsed them. Providers must promptly update profile information if credentials, licensure, availability, services, or eligibility change.
04 Attorneys and Regulated Professionals
Attorney Providers and other regulated professionals are solely responsible for maintaining licensure, complying with professional rules and advertising rules, determining whether they may provide services to a particular User, conducting conflict checks, determining when and whether an attorney-client relationship is formed, using appropriate engagement letters or disclaimers, maintaining confidentiality and privilege where applicable, complying with fee-sharing/referral/trust-account/professional-independence rules, and limiting services to jurisdictions where they are authorized to practice.
The Platform is not a law firm, does not supervise professional judgment, does not provide legal advice, and does not participate in attorney-client relationships.
05 Non-Attorney Restrictions
Non-attorney Providers may not provide legal advice, hold themselves out as attorneys, create attorney-client relationships, appear in court, practice law, prepare legal documents in a manner constituting unauthorized practice, or provide regulated legal services unless properly authorized.
06 Provider Services and Standards
Providers must perform Services honestly, professionally, and in compliance with applicable law, Platform policies, and any professional obligations applicable to them. Providers may not guarantee outcomes, misrepresent experience, misuse User information, or provide Services that are illegal, deceptive, unsafe, discriminatory, or outside their authority.
07 Payments, Fees, and Payouts
Users pay through the Platform at booking. Providers may be charged a 15% platform fee when a booking is accepted, subject to category-specific, legally required, or Platform-approved modifications. Providers are responsible for taxes, reporting obligations, and financial compliance.
Fees applicable to attorneys or other regulated professionals may be modified, limited, or structured differently where required by applicable law or professional rules. Providers are solely responsible for determining whether participation in the Platform and payment of applicable fees are permitted under their governing rules.
Providers may be required to provide bank account or payout information. Providers are responsible for maintaining accurate payout information. Payouts may be handled through Stripe or other payment tools and may be subject to processor rules, delays, holds, verification, disputes, chargebacks, or account limitations.
08 No Off-Platform Circumvention
Providers may not solicit, request, accept, or direct off-platform payment for any service initiated through the Platform. Providers may not use the Platform to obtain User contacts and avoid Platform fees, Platform payments, or Platform policies.
09 Cancellations, Refunds, and No-Shows
The current Platform build allows cancellation before payment is completed. Refund functionality is not currently implemented. Providers must not promise refunds, cancellations, or payment outcomes not supported by Platform functionality or written Platform policy. Chargebacks and payment disputes may be handled by the payment processor under processor rules.
10 Confidentiality and User Data
Providers must protect User information received through the Platform. Providers may use User information only to provide Services requested through the Platform and may not disclose, sell, misuse, or exploit User information. Providers must comply with applicable confidentiality, privacy, professional, and ethical obligations.
11 Uploaded Documents
Providers may receive access to sensitive User documents. Providers must use such documents only for the requested Services, protect them from unauthorized access, and delete, return, or preserve them as required by law, professional obligation, Platform policy, or applicable engagement terms.
12 Communications and Meetings
Providers should use Platform-approved messaging and meeting tools for Platform-initiated Services. Providers may not record meetings unless all required consents are obtained and recording is permitted by law and Platform policy. Providers are responsible for their own communications, advice, meeting conduct, confidentiality practices, and recordkeeping.
13 Reviews and Featured Placement
Providers may be rated or reviewed by Users. Featured placement may be based on reviews or Platform activity and is not paid placement unless expressly disclosed. Providers may not submit fake reviews, manipulate reviews, suppress negative reviews, retaliate against reviewers, or misrepresent review status.
14 Intellectual Property and Platform Restrictions
The Platform’s software, design, workflows, branding, content organization, database structure, Provider directory, user interface, and proprietary business concepts are owned by the Platform or its licensors. Providers may not copy, scrape, reverse engineer, reproduce, adapt, or use Platform materials or information to build or support a competing service.
15 Insurance
Providers are responsible for maintaining insurance required by law or appropriate for their services. Attorney Providers and other regulated professionals may be required to provide evidence of professional liability coverage if the Platform adopts such a requirement. Any insurance confirmation by the Platform does not constitute endorsement or guarantee.
16 Complaints, Suspension, and Removal
The Platform may suspend, restrict, remove, or terminate Provider access if it receives complaints, identifies misleading credentials, suspects unauthorized practice, identifies unsafe conduct, receives legal process, detects policy violations, or determines that continued participation creates risk to Users or the Platform.
17 Provider Indemnity
Providers agree to indemnify and hold harmless the Platform, its owners, officers, employees, contractors, service providers, and representatives from claims arising out of Provider Services, advice, work product, communications, profile information, credential misrepresentations, professional misconduct, unauthorized practice, privacy violations, off-platform transactions, or violation of these Provider Terms.
18 Governing Law and Venue
These Provider Terms are governed by the laws of the District of Columbia, without regard to conflict-of-law principles. Venue for disputes shall lie in the appropriate courts located in the District of Columbia, unless otherwise required by applicable law.
